Yes, you can upgrade to anytime and in your case, if you had labor approved and I140 pending until Nov 1st, then you can upgrade to PP, wait for its approval and apply for a 3 year extension.
You can also apply for H1 before and when I140 pps goes through, notify CIS about your I140 approval with a request to grant a 3 year extension instead of 1.

If you file in 2008 (No matter whetehr it is Eb2 or Eb3), as per present situation u can forget for next 10 + years.
I feel this may not be true.

I am in a similar position, but slight variations.
H1B from Jul 2003. Already on 7th year extension which expires in Oct 2010. My Priority date is Jun 2007 and I-140 is already approved but, I could not apply for I-485 in Jul 2007 window.
I have the following questions.
1. Can I change a job ? If so, for how long will the H1-B be valid.
2. If the H1-B is valid, can the USCIS reject the application if the my current employer decides to revoke the I-140.
3. If I-140 is revoked, is there is possibility to port the priority date or will it be an entirely new priority date based on new application.
I have been getting conflicting opinions from different people. A particular immigration lawyer I consulted adviced me against a job change, though I might get a new 3 year H1B, he feared CIS might revoke it if I-140 is revoked (it is quiet clear my employer will revoke the I-140). I'll be applying for my wife's and my visa stamping and therefore did some research on this issue myself. I believe that we'll need to print out DS-160 as well and take it to the consulate, the same way we did with previous forms. We can, therefore, write our names (or whoever is the applicant) in our native language on it.

It's OK to stay while change of status (COS) is pending if COS was filed before I-94 expiration (your case). Even though your wife will be technically out of status after 1/3/09, she is not going to accumulate unlawful presence because her stay is authorized by US Attorney General. Out of status is not a big deal. A person who came on H1 and filed for AOS does not have any status if H1 expires, but that person is lawfully present in US.
So wait for a decision on COS and if it is denied, your wife has 180 days to get a lawful status or to pack and leave without any adverse consequences.

I totally applaud him/her if he is making 300K a year and my advice to him/her is that you should not care wether you have a h1b or not, GC or not etc. Just make sure that you deposit your earnings in swiss banks and whenever USCIS throws you out show them the middle finger and go live in Aruba,. I am planning to book tickets for my parents travelling from India to US and returning back to India after 2 months. I have some questions:
1) Is it necessary to book tickets in India?
2) If not, Can I book tickets through orbitz or expedia in the US and send them the e-tickets?

I have booked tickets on orbitz.com for my parents and cheaptickets.com for my in-laws. Both were eTickets and there were no problems. I preferred to pay in USD over INR due to the fact that visa/ mastercard charge a 1% transaction fee for international currency and my bank would have screwed me on the exchange rate.

States accumulate spill over from Q1 to Q3 but doesnot apply. Those extra visas will not be given to any one .. Once gone from quarter then it cannot be given to any one. In last quarter it will go to Eb2 India.

Even if you use AP to re-enter, instead of a H1 visa, you may still be able to maintain your H1 status, provided you continue working for the same employer.

Very easy. No need to file new 485 or CP. Interfile, by sending the copy of new 140 approval notice to your pending 485. Requset them to consider your latest approved Eb2-140 as a underlying immigrart visa petition for your pending 485. Ofcourse, you need a latest employment offer letter from the original sponser when requesting the change.

Just updating my case in case someone is going through same situation and need help.
I mailed the two pictures that they requested on June 2nd, as today, my online status hasn't change, still says: Request of evidence sent, case placed on hold.
I made an INFOPASS appointment last friday and I just came back from talking with an immigration agent. They will expedite my I-131 for free, they said they normally do it within 30 days but he liked me and he said he was going to try to get in just 5 days.
He said he sent a request thought their intranet to the TEXAS SERVICE CENTER, they should be calling me if they need anything, if not, they will send me the TRAVEL DOCUMENT right away.
I'll keep you all posted!

Hi,
I need to draw the IV website admin's attention to a minor style sheet issue which is making the site look a little bit "wonky" in Internet Explorer 6.0.
The CSS needs to be adjusted, as the "Contributions section" in the right most column is appearing midway on the page instead of way up top like it should in the other browsers.
I am trying to attach the image but it seems like I cannot attach anything with an image width of > 800 or an image height of 600.

I saw the same thing in my online status, in october. What I got is a finger print notice which was originally sent to my old address which was on the I-485 application form. They redirected to it to the current address on file.
This is my guess: Since the online status has only few options, and may be the person who is updating it put it as 'document sent' and the one similar to that is the last one with 'Document production ....".
What I heard is, before they mail your GC, you will get a letter saying your I-485 is accepted. I never got that. I called USCIS and 'human robots' didn't have any idea on this, but they said my I-485 is still in the processing stage.

The issue is not H1 transfer - i transferred it 5 weeks back and know multiple folks who will transfer again.
The issue is they are not been able find projects quickly - without Projects the transfer may not be approved ( this is happening these days) and also who will pay me without getting money from client ??
