I believe there are very few left before April 1st 2004. EB2 I was stuck at April 1st 2004 for a long time and never moved from that date (excluding 2-3 times for a month or two when2006 people got approved). There will be lot of people from first half of 2004.
Yeah, before it went to Dec 1999, it was June 2004 i think and during the August 2006 current time lots of 2005s and 2006s got approved.
Since its till Jan 2005 this time i reckon its purely gonna be core 2004.

Yes you could request that the same I-485 be used for your new I-140, as one member has suggested, you could also ask for the priority date of the old I-140 to be ported to your new I-140 if you are worried about priority dates for EB-1. Provided the old I-140 is not revoked.

What about all H1-B, L-1, J-1, K-1....all potential EB immigrant, pick a date and do not spend anything on that day. That will hurt this economy and get some attention. Please do not tell me that people on H1 and L1 do not make and spend enough money.

I don't think it is not a issue as my friend's father also a retired Navy personel with the INdian Navy had no issues. All he had to so is show that he is a retired personnel and may have to show proof that he is just coming to visit and not to stay back.

It seems as per the new DOL Requirements two notices has to be posted at two locations ( One at Employers office and one at the client location. U.S. Department of Labor (DOL) regulations requires that a Posting Notice be posted within your organization in two conspicuous locations for 10 consecutive business days)
As this H1-B posting info might contain the salary details etc. What happens if the client policies doesn't allow posting such notices ?? so what other options are available in such a case..
The DOL requirements are not new, it's just that the method for filing the LCA is new. The employer has always needed to post the LCA, including salary information. This is not optional, so if the employer refuses, there can be no H-1B.

I am a Chartered Accountant from India with 10 years of Post Qualification Experience.
I am currently working on H1B since last 1 year and working as System Consltant for last 4 years.
I do not have any other master degree like M. Com / M.Sc etc.

Hello everyone -
I am planning to change my job and would like to seek some advice. I already used AC21 once without informing USCIS, and now would like to do it again. I would like to seek advice on couple of issues:
1. I would like to do this without informing USCIS and worry about a response if and and when I get RFE. However, new employer has E-Verify system. Would them checking my eligibility to work through E-verify make it certain that I would get an RFE for employment verification?? In other words, E-Verify tells USCIS that one has changed employment? or E-verify and 485 have no connection?
2. My new job is in the same engineering field; however, there is still a big difference in salary owing to additional managerial duties. Labor was done based on technical responsibilities in engineering field, new job involved technical as well as business responsibilities in the same field. With years going by, I am taking on more and more project/division management experience and that is what the new position would entail.

I had a similar experience. Four weeks after my I-140 was approved, I had another LUD and when I checked the online status, it had the same message that you mentioned. When I asked my lawyer, he told me that it ususally means that the employer has received a copy of the approval as well. And sure enough, 3 days later, I found out from HR that they received the I-140 approval letter and they wanted to know what to do with it.
Does this mean both the employer and employee get their separate copies of I-140? I assumed only the employer/lawyer gets to have the actual I-140 approval.

Hello,
Last November I quit my job in the US and left the country as well. Two days ago, I received an email saying my 485 is approved, and card production was ordered. The card will go to an address in the US where someone can forward me the mail.
What should I do? Try to enter the U.S. with the card? What to say to POE officials? WIll I be questioned?

Once you get your green card, you are supposed to go work for the company who applied for your green card or work in a same or similar job. So it is good to have a job offer in hand. Talk to an Attorney on what are the potential questions at POE as you have been out of the country for a long time.

My brother moved jobs early last year. He filed AC21 and got an RFE immediately.
The move was parallel in job function and the pay was good.
They replied to the RFE and then never heard back. In these economic times, USCIS
is scrutinizing every doc that gets filed.

Our demand should be reasonable.. The law makers knows what kind of people they want. One may have MBA or MA, and they may feel their degree is valuable to America. However it is up to the lawmakers to decide what they want.
One guy was asking whether social science considered as science as it is having science. I am not undermining any degree or any branch. We have to appricate atleast they are excempting STEM from numarical count.
As knnmbd said, the period of IT is over. Manufacturing has gone to China. IT has gone to India. What america need at this moment is innovation, research, new technology, alternate energy to overcome growing energy crisis, environmental care health care, nanotechnology, any advanced research to keep america in leading edge. Thats why lawmakers are talking about STEM.

KINDLY PLEASE EXPLAIN THIS TO ME IF YOU HAVE AN IDEA ABOUT IT.
I CAME INTO THE COUNTRY AS IMMIGRANT AFTER TWO YEARS OF MARRIAGE WITH MY US CITIZEN WIFE.THOUGH MY PASSPORT WAS STAMP AT THE PORT OF ENTRY JUNE 8, 2008.AND THE IMMIGRATION OFFCIER AT THE PORT OF ENTRY WROTE IR1 ON MY STAMP PASSPORT.BUT ABOUT THREE WEEKS LATER I RECIEVE A LETTER FROM THE USCIS THAT A CARD WAS CREATED AND MAIL TO THE ADDRESS WE HAVE ON FILE BUT WAS RETURN UNDELIVERED BY THE POST OFFICE.6 MONTHS AFTER MY ARRIVAL TO US THE CARD WAS ALSO RESENT TO ME UNDELIVERED AFTER I MOVING WITH MY WIFE TO ANOTHER BIGER APARTMENT WITHING THE SAME ADDRESS. THOUGH I NEVER KNEW THE PROCESSES OF CHANGING OR INFORMING THE USCIS OF CHANGE OF ADDRESS BUT I DID UNDERSTAND NOW WITH THE HELP PF THIS LOVELY SIDE AND OPEPEL LIKE YOU AND I DID THAT STRAIGHT AHEAD.I CALLED THE USCIS ON 31ST OF DECEMBER,2008 TO INFORM THEM OF MY NEW ADRESS AND I MAIL FORM AR-11 ON EXPRESS TO THEIR OFFICE IN LONDON,KY.BECOUSE WHEN I CALLED USCIS OF THE CHANGE OF ADDRESS I WAS ALSO TOLD TO FILL THE FORM ON THEIR WEBSIDTE AND ALSO DOWNLOAD THE FORM FILL IT AND MAIL. THE USCIS SAID EVEN THOUGH THEY HAVE CHANGE MY ADDRESS ON PHONE.THEY MAIL WAS DELIVERED TO THEM ON THE JANUARY 9,2009. TIME WAS 12.30P.M..SO THIS WAS THE MAIL I GOT FROM THEM ONLINE AFTER TRACKING MY CASE..

After showing all the documentation and the AC21 law links to USCIS site, my lawyer and immig dept agree that 03-Aug-2007 is my receipt date.
so my 180 days start from 03-Aug-2007. Quite a relief for me.
On the other side, I already lost out on 1 opportunity coz they took so much time to get back with the answer. I hope something clicks in the near future.
